Job description

About this role

Intellectual Strategies is a unique type of law firm. We offer a “Fractional Legal Team” for startup/scaleup SaaS, ecommerce, and technology companies. Our clients hire us on a retainer basis to effectively be their in-house legal team, although on a fractional budget as they scale and grow.

Part of our client work involves litigation and alternative dispute resolution. For matters in Utah state and federal courts, this attorney would handle the litigation directly.

When litigation arises in states where we aren’t licensed, we bring in local counsel and quarterback the process on the client’s behalf, staying in the driver’s seat on strategy, budget, and communication while local counsel handles the state-specific procedural work.

This is a remote position. We hold short team meetings a few days per week, typically 15 minutes long between 9:45-10:00 AM. We currently have active litigation in Utah, and some matters may require in-person appearances in Utah courts, so candidates must be based in Utah.

We are looking for a Utah-licensed general business litigator with 4+ years of full-time experience who can independently manage litigation matters from intake through resolution on a contract, overflow basis (although with the support of our staff). Excellence in contract disputes is essential, experience with IP disputes is a plus.

You should also be comfortable communicating directly and effectively with executive teams and board members. This is critical, as our clients expect GC-level judgment and clarity, not just legal updates.

Our core values guide how we work with clients and with each other. We expect every attorney on our team to give advice grounded in the client’s business strategy, recommend a clear course of action, and follow through on every commitment.

We are growing our team and are specifically looking for an experienced litigator we can turn to regularly for our clients’ needs. As an attorney in this role, you would be available for overflow work that varies in scope and complexity depending on our clients’ needs. You would be a 1099 contractor providing services to our law firm, on behalf of our clients.

The hours available for any attorney in this role can vary greatly, from a good amount of work on a project to very little work for extended periods of time, with the expectation of growing the workload and team participation over time.

This position is ideal for an experienced attorney who is currently looking for flexibility with a light amount of overflow work at overflow rates, similar to the hourly payroll compensation rates you might experience as an attorney in a boutique law firm.

While not required, this role could also be a great opportunity for a litigator interested in building a litigation practice with our firm. We have a marketing team in place, and we are open to growing this role alongside our current litigation work.

Compensation

$100-150/hour, depending on experience (1099 contract)

Requirements

  • Active license in good standing with the Utah State Bar
  • Based in Utah and available for possible in-person Utah court appearances
  • Admission to the U.S. District Court for the District of Utah (or eligibility and willingness to obtain it promptly)
  • 4+ years of full-time general business litigation experience, with substantial work on contract disputes and IP disputes a plus

If you would like to be considered for this litigation attorney role that our Fractional Legal Team attorneys turn to for assistance with overflow projects, with the potential to possibly grow into a more comprehensive role within our Fractional Legal Team, then please submit your information.

Please submit a cover letter that clearly indicates:

  • Your Utah State Bar number and the courts you are admitted to practice in
  • Your litigation experience, with particular emphasis on contract disputes and IP disputes
  • Your experience communicating with executive teams and/or boards of directors
  • A brief explanation of how you are efficient and client-oriented in your approach to practicing law

We will evaluate candidates on typical qualifications of competent and client-oriented attorneys. Our startup/scaleup clients and our internal team are not willing to tolerate inefficient, overcomplicated, obstructive, or verbose attorney practices.

THIS JOB POSTING MIGHT NOT BE FOR YOU

We try to be responsive to our applicants. However, we cannot spend time responding to applicants who are clearly outside our hiring criteria. To help you know if you’re outside our hiring criteria, please refer to the following:

  • If you are not actively licensed by the Utah State Bar, then this job posting is NOT for you.
  • If you are not based in Utah and able to appear in person in Utah courts when needed, then this job posting is NOT for you.
  • If you are looking for new clients who will pay you market rates, then this job posting is NOT for you. We are NOT looking at this time for attorneys who want to charge market client rates to us. We already know and could easily hire attorneys from top law firms who charge market client rates, but that is NOT what we are looking for.
  • If you are looking for full-time work now, then this job posting is NOT for you.
  • If you are looking for a W-2 position with employment benefits now, then this job posting is NOT for you.
  • If you are not friendly, available and responsive (within reason for an overflow position), or interested in working with us on projects for clients that inherently have a little chaos, then this job posting is NOT for you.
