Role Overview and Responsibilities

The Private Wealth Management (PWM) Legal team is seeking an experienced attorney to support the firm's residential mortgage lending business serving high-net-worth and ultra-high-net-worth clients.

The attorney will serve as a primary legal advisor to the mortgage business across origination, modification, servicing, enforcement, and restructuring, with particular focus on mortgage documentation, entity formations, loan structuring, title and lien matters, collateral enforcement, and consumer lending regulations.

Key responsibilities include:

  • Advising mortgage origination, underwriting, servicing, operations, risk, compliance, and business stakeholders.
  • Advising on jumbo mortgages, home equity lending, custom credit structures, and loans secured by complex real estate holdings.
  • Reviewing loan agreements, notes, mortgages, deeds of trust, guarantees, consumer disclosures, and modification agreements.
  • Advising on title, survey, lien priority, curative, and closing matters, including title defects, easements, encroachments, unreleased liens, and chain-of-title issues.
  • Managing and partnering with external mortgage, title, and local counsel and settlement agents across jurisdictions.
  • Advising on federal and state mortgage and consumer lending requirements, including ECOA/Regulation B, TILA, RESPA, Fair Housing Act, flood insurance, and related frameworks.
  • Supporting regulatory examinations, audits, internal controls, and updates to policies and procedures.
  • Advising on lending to private wealth clients using trusts, family offices, multilayered entities, and other complex ownership structures.
  • Assisting with escalated servicing, default, enforcement, foreclosure, and loss-mitigation matters.

Qualifications

  • J.D. and active membership in at least one U.S. state bar.
  • At least 5 years of experience advising mortgage lenders, banks, financial institutions, or private banking businesses.
  • Significant residential mortgage experience across origination, documentation, servicing, enforcement, and collateral matters.
  • Expertise in title review and curative matters, including title defects, lien priority, unreleased liens, trust and estate title issues, surveys, and closing concerns.
  • Strong knowledge of ECOA/Regulation B and residential mortgage requirements, including TILA, RESPA, Fair Housing Act, flood insurance, UDAAP principles, and applicable state laws.
  • Experience advising a regulated bank, preferably in private banking, wealth management, or a high-net-worth client business.
  • Ability to provide practical, business-oriented advice while balancing legal, regulatory, reputational, and operational risk.
  • Strong communication, collaboration, and problem-solving skills; experience managing outside counsel and advising senior stakeholders preferred.

Preferred Experience

  • Private banking or wealth management mortgage lending, including jumbo mortgages and ultra-high-net-worth clients.
  • Familiarity with New York, California, Texas, and other key private banking market mortgage laws and practices.
  • Experience with trusts, LLCs, family office, and other complex private wealth borrowing structures.
